Data Privacy Statement
This is the data privacy statement of upjers GmbH, Hafenstrasse 13, 96052 Bamberg, Germany. It is valid for all websites and games operated by upjers.
The following includes an explanation of the most important terms, in order to facilitate an understanding of this data privacy statement:
1. What is personal data?
Personal data is data which identifies you as a person. This includes, for instance, your real name, email address, telephone number, postal address, or credit card information.
2. What is user data?
User data is data upjers collects from you, processes, and saves when you visit or use websites and games operated by upjers. User data in particular includes attributes of identification (such as the domain name and/or the IP address of the computer you use to connect to upjers).
3. What are IP addresses?
IP addresses serve to identify devices that are connected to the internet. Each computer that is connected to the internet can be allocated a certain IP address, that is, a specific combination of numbers.
4. What is a cookie?
When accessing our websites or games, upjers, or more specifically, upjers’ hosting-provider, collects data pertaining to this access via the so-called server log files. The data collected during this process includes the name of the specifically called website or file, the date as well as the time the site was called, the amount of data transmitted, your operating system, the type of browser you used, the website you visited before, your IP-address, your browser, as well as a report confirming the successful transmission of the respective website.
Furthermore, upjers collects, processes and saves personal data that you have willingly passed on in electronic or other forms of communication (such as in forms or otherwise on websites and games operated by upjers). This also includes data you confide to other users, by communicating with them via upjers’ games and sites. upjers advices you to treat this data with great care, and to carefully consider who you communicate with, as well as what you communicate via the games and websites operated by upjers. Certain information such as communication between users may also be visible to other users of upjers’ websites and games.
In order to sign up for the use of games operated by upjers, you generally need to identify yourself by entering your email-address. If you want to make use of additional offers inside the games, upjers may need further information, such as for instance your bank details.
Here are a few examples of the data that upjers saves:
If you sign up on a game operated by upjers or use it, upjers automatically saves the domain name and/or the IP address of the computer you use to contact upjers.
upjers saves your email address, if you have transmitted it to upjers. Information on which further data may be collected in occasional other cases, can be gathered by the respective input masks.
§ 2 Use of Personal Data
a) upjers will only collect, process or pass on your personal data if this is legally permitted, or if you have given your consent. upjers only makes use of the data gathered by server log files for statistical processing for the purpose of operating these websites and games, in order to ensure the security and optimization of these websites and games. upjers reserves the right to subsequently control this data if, based on concrete evidence, there is legitimate reason to suspect an unlawful usage of the websites and games.
upjers uses data entered during the process of signing up for the purpose of using the websites and games. upjers may send you information via email containing changes to the scope of service of the respective websites and games or technical details.
In case of contacting upjers – for instance via a contact form or email – your data is being saved for the purpose of treating your request. This also is the case in case further questions may arise.
upjers furthermore collects, processes and saves your data, in order to allow upjers a better understanding of your usage of the websites and games operated by upjers, and to consequentially be able to offer you better services. That means that upjers, for instance, won't just be able to use the saved data to directly carry out the user contract including all its possible forms of use (such as using the games, participating in services connected to games, use of customer support), but also to detect malfunctions or misuse of upjers' websites and games.
b) We are happy to inform you about our company as well as the games and services provided by upjers via newsletter.
If you wish to receive our newsletter, upjers needs a valid email-address from you. Furthermore, upjers needs information that allows us to check whether you are really the owner of the indicated email-address, or if the user of the email-address has consented to receiving the newsletter (“verification”). When signing up for our newsletter, upjers therefore saves your IP-address and the date of your registration. This only happens for the purpose of gathering proof, in case a third person has misused another person’s email-address and signed up for the newsletter without the owner’s knowledge. upjers gathers no further data. This data is only used for the purpose of sending out the newsletter, and will not be passed on to any third person.
The technical process of sending out the newsletter is being carried out by emarsys eMarketing Systems AG, Märzstrasse 1, 1150 Vienna, Austria by order of upjers.
If you don’t wish to receive any of our newsletters, you may opt out of receiving them at any time. To do this, please click on the link “Upjers - Newsletter unsubscribe!” which you will find at the end of each newsletter.
Besides, you may of course revoke your consent to receiving the newsletter at any time by other means, for example, in writing (for instance via email to firstname.lastname@example.org), without incurring any costs, except for the costs of transmitting the revocation (to the basic tariffs).
c) upjers may pass on user data to service providers charged with collecting payments, inasmuch as this is necessary to calculate the payment and to charge you. upjers furthermore may offer user data to third-parties if upjers has commissioned them to recover debts, inasmuch as such data is necessary to claim those debts. upjers will inform you about the name of these third-parties upon request. In case upjers cooperates with third-parties to offer its services, upjers will ensure that they adhere to the applicable data security laws and offer ample data protection.
You may change your personal data at any time (such as by updating or correcting them) or delete your data entirely. If you want upjers to change your personal data or stop using your personal data, you may contact upjers via email@example.com. upjers will then change or delete your data as quickly as possible. upjers informs you, however, that, due to technical or organizational conditions it might be possible that some measures will still need to be carried out even after the demand of deletion, should these already have begun but haven't been completed after you have informed upjers of your wish to be deleted. Furthermore, it might be possible that we may only be able to entirely delete your data at a later date, in case of existing mandatory data retention obligations.
§ 4 Separate Notes
1. Use of the Scalabe Central Measurement Method
upjers uses the "Scalable Central Measurement Method / Skalierbares Zentrales Messverfahren" (SZM) by INFOnline for several of its offers to determine statistical parameters in the scope of upjers' services. In doing so, anonymous measures are collected. For the recognition of computer systems, the SZM audience measurement uses alternatively either a cookie with the identifier "ivwbox.de" or a signature which is created from various information that is automatically transferred by your computer. IP addresses are not stored via this method and only processed in anonymized form.
The audience measurement was developed in consideration of data protection. The goal of the audience measurement is to statistically determine user intensity and the number of users of a specific website. Individual users are not identified at any point in time. Their identity is always protected. They will not receive any advertizing via the system.
For websites which are members of the IVW German Audit Bureau of Circulation (Informationsgemeinschaft zur Feststellung der Verbreitung von Werbeträgern e.V., www.ivw.eu) or that participate in the study "Internet Facts", organized by the Work Group Online Research (Arbeitsgemeinschaft Online-Forschung e.V., AGOF), user statistics are published monthly by the AGOF and the AGMA (Arbeitsgemeinschaft Media-Analyse e.V., ag.ma), as well as the IVW and can be viewed at http://www.agof.de, http://www.agma-mmc.de and http://www.ivw.eu.
In addition to the publication of measurement data, the IVW also regularly checks the SZM process to ensure that it is used in accordance with regulations and data protection.

3. Usage of GoogleAdSense
Insofar as advertisements are being displayed on our websites by Google Adsense, an advertisement service by Google (banners, text ads), your browser may be saving cookies sent by Google. Furthermore, Google Adsense makes use of so-called “WebBacons” (invisible graphics) to gather information, whose usage permits the saving, gathering, and processing of simple actions such as the user traffic on the respective website. upjers has no influence on this data collection. We however assume that at least the visit of the site as well as the user’s device code are being recorded. The information gathered by cookies or web bacons about the visit of the respective website (including your IP-address) and the transmission of advertisements will be transmitted to a Google server in the USA and saved there. Google will hereafter solely use the gathered information, to offer you selected advertisements designed to meet unique requirements that should, as much as possible, also be in keeping with your own individual interests. Google may also transfer this information to third parties especially where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.
You can prevent the storage of cookies on your hard drive. To do this, you need to select the corresponding setting in your browser-settings, such as “Block sites from setting any data”; however upjers informs you that you may not be able to use all functions of this offer to their full extent in this case. By using this website you are consenting to the processing of the data gathered about you by Google in the aforementioned means, and to the aforementioned purpose.
4. Usage of Social Media Plug-ins
upjers offers its users the following social media plug-ins in the scope of its internet offers:
- Google "+1"-button of the social network Google+, operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA;
- Twitter "Tweet" of the communication platform Twitter, operated by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA.
The plug-ins are developed and provided by the respective operators, and integrated into our websites unchanged. By using the respective buttons, users are able to recommend the respectively visited website. That way, you can recommend offers by upjers to your friends in Facebook, other users of Google Plus, as well as followers on Twitter. If you, for instance, click the “Like”-button, your Facebook-page will display the message that you recommend our service. If you use the “+1”-button by Google Plus, your recommendation will appear on your Google Plus-profile, or the search results of the search engine “Google”. Furthermore, your recommendation may be displayed on websites and ads of third persons in connection to your profile name and profile picture. Using the Twitter button, you’ll be able to share an entry or page of upjers’ offers on Twitter. Aside from the aforementioned functions, these buttons allow an automatized communication between websites and the respective platform.
Once you activate the plug-in of another platform, your browser builds a direct connection to their servers in the USA, and will afterwards communicate with the respective service. The content of the plug-in will be loaded directly into your browser by the servers, and integrated into our website by them.
We therefore have no influence on the amount of the data the platform operators are collecting by means of these buttons, and inform you according to our knowledge: we assume that the visit of this website, the confirmation of the button and the IP-address are being recorded.
Accordingly, the implementation of the social plug-ins is allowing Facebook to gather the information that you have called the respective website of upjers’ offer. If you are logged into Facebook during that time, Facebook will be able to connect your visit to your Facebook-account. By interacting with social plug-ins, for instance by clicking the “Like”-button, the respective information is being transmitted by your browser directly to Facebook, and saved there. If you are not a member of Facebook, it is still possible that your IP-address may be saved, however, according to Facebook, in Germany, only an anonymized IP-address is being saved. If you are a member of Facebook, and don’t want Facebook to gather data via upjers’ offer and link them to your user data saved on Facebook, you need to logout of Facebook before visiting the websites containing upjers’ offer.
According to Google, no personal data is being collected, if you don’t click the “+1”-button. Accordingly, personal data is only being collected and processed from members that are logged in, among others the IP-address.
As far as we are aware, when clicking the Twitter-buttons, only your IP-address and the URL of the respective website upjers’ offer is on, will be transmitted, and not used for any other purposes other than the display of the button.
In case you have a user profile on a platform, you should be aware that the platform’s operator is able to link information to your user account as soon as you activate the respective plug-in. If you don’t agree to this, you should log out of your user profile, before activating a plug-in.

5. Data usage in integrated games
Some upjers games are integrated to platforms of social networks (especially Facebook). There, these games are referred to as so-called “apps” or “applications”. If you wish to use these games, you are being prompted to allow the collecting/saving of, for instance, the following data by upjers:
- First and last name, gender, date of birth
- Profile picture or respective URL
- Login email-address used for signing up on Facebook
- Location and access devices
- User ID number, which is linked to publically available information (on Facebook)
- User ID number to your friends that are also connected to the game
By confirming the button “Allow“, you consent to the collecting, saving and processing of your data.
upjers informs you that the amount of information upjers receives from Facebook can be influenced by respective privacy-settings. You may be able to especially exert your influence by:
- controlling which information you share with/about your Facebook-friends,
- blocking special applications or stopping them from collecting specific information about you,
- ignoring specific game-invitations,
- controlling, who is able to view your activities.
In case upjers offers the possibility to use one or another game without the usual registration process, you receive a guest account. By using such a temporary guest account, the utilization of additional services for valuable consideration is not possible. You will not be prompted to depose personal data (such as your email address). Instead, you are granted access to the game by using a guest name and a corresponding password.
The guest name created in the scope of the guest account (that you will be informed of in the game) will automatically be deleted after a certain period of time following your registration. You may, however register for the game. The personal data obtained in the scope of the registration are then dealt with as is indicated in this data privacy statement.
§ 5 Disclosure of personal data
Upon request, upjers will inform you about all data stored about you without costs. This information will always be transmitted in electronic form, generally via email.
§ 6 Third-Party Websites / Links
In case you are forwarded to another website that is not operated by upjers, via a link contained on one of the websites and games operated by upjers, upjers informs you that this data privacy statement is not valid for third-party websites. upjers cannot be made liable for how the providers of third-party websites handle your data. In particular, upjers cannot be made liable if such websites do not follow the same data privacy standards upjers offers you. upjers therefore recommends that you always carefully read the data privacy statements of linked sites.
§ 7 Changes of Data Privacy Statement
upjers reserves the right to change this data privacy statement at any time, however, upjers will always adhere to the currently applicable data security laws. upjers advises you to inform yourself on each visit to these websites and games about the current data privacy statement. In case upjers plans on using your personal data on a larger scale than has previously been the case, upjers will of course notify your beforehand.
